Verdicts and Settlements
Couple gets $5.5 million settlement from trucking company in I-35W wreck
By Martha Deller
A couple seriously injured last year when a tanker truck hit their car on Interstate 35W near Burleson have received a $5.5 million settlement from the Oklahoma company that owns the truck.
Mary and John Reutter received the settlement after a mediation conference last month between their attorney and those representing United Petroleum Transports.
"This will ensure that my clients are compensated for their injuries for the rest of their lives," said William Berenson, the Fort Worth attorney representing the Reutters.
Jordan case
$2,225,000.00 gross settlement for the wife and daughter of Jimmy Jordan, a fine husband and father and hard working truck driver who was tragically killed in 2005 in Fort Worth when he crashed into a stopped garbage truck that ran out of gas on 130. The defense attorney from Dallas argued among other things that the collision was Jimmy's fault, that Jimmy had not experienced any conscious pain and suffering, that he had no medical bills, and that he was intoxicated at the time. The lawsuit concluded with cocounsel in January 2007.
Walters case
$1,500,000.00 aggregate gross settlement (policy limits) for the family of Robert Walters, a wonderful young commercial tow truck driver who was tragically killed in 2005 as he was underneath a stalled 18 wheeler on 135 north of Denton. The defense attorney from Dallas argued that the driver of the second 18 wheeler who crashed into the first truck had suffered an unexpected heart attack and was not at fault, that Robert had died instantly, that he had no medical bills, and that he left no family. The federal lawsuit was concluded in Marshall, Texas with cocounsel in May 2007. See the video clip from KDFW news coverage of this lawsuit called "Cops: Almost Half of Big Rigs Pose Danger" on "In the News" page.
Morris case
$1,000,000.00 gross settlement (policy limits) paid in July 2007 without a lawsuit having to be filed to Ron Morris, a kind, retired gentleman injured in 2006 while driving his SUV. The adjuster in Atlanta argued that there was absolutely no visible damage to the SUV's rear bumper, that Ron was not hurt, that he had been previously injured, that he had lost no wages, and his medical bills had been largely paid by insurance. My client unfortunately ended up needed major back surgery. Ron was extremely pleased with the settlement and wrote this note:
Bill,
Just wanted to say THANK YOU again for all your hard work on our case. You don't know how very much we appreciate what you were able to do for us. You should feel extremely proud.
Best wishes,
Ron
